This Privacy Policy describes how Mojito, Inc. (the “Company”), acting on behalf of The Pace Gallery LLC (“Pace” and collectively with Company, “we” or “us”), collects, uses and discloses information from users of the Pace Verso NFT website (http://verso.pacegallery.com/), as well as the content, applications, services, tools and features made available therein (collectively, the “Services”). For purposes of this Privacy Policy, “you” and “your” means you as the user of the Services. If you use the Services on behalf of a company or other entity then “you” includes you and that entity, and you represent and warrant that (a) you are an authorized representative of the entity with the authority to bind the entity to this Privacy Policy and (b) you agree to this Privacy Policy on the entity’s behalf.

Company or Pace may collect the following categories of information from you (“Information”), which includes

  • We use “cookies” and other technologies to collect data that enable us to better understand and improve the usability, performance and effectiveness of our website. We use cookies to gather general information about your visits to our website, the files you have designated for backup, the configuration of your computer and your computer’s interaction with the Services, and stores this information in log files. Neither Pace nor Company will share your Personal Information outside of Pace or Company, as applicable, except in limited circumstances, including:
  • When you allow Pace or Company to share your Personal Information with another company, such as directing us to share your Personal Information with third-party sites or platforms, such as social networking sites;
  • When Pace or Company contracts or partners with a third party to provide services on our behalf, including Services development and maintenance. We require all third parties to process your data in accordance with this Privacy Policy and as permitted by applicable data protection laws; and
  • When Pace or Company share Personal Information with third parties in connection with the sale of a business (including merger, acquisition, or sale of all or a material portion of its assets, change in corporate control, or insolvency or bankruptcy proceedings), to enforce our Pace Verso Terms of Service or rules, to ensure the safety and security of our users and third parties, to protect our rights and property and the rights and property of our users and third parties, to comply with legal process, including judicial warrant, rule, order or subpoena or in other cases if we believe in good faith that disclosure is required by law or regulation.
In addition, we may share Non-Personal Information with third parties, alone or in combination with your Non-Personal Information or the Non-Personal Information of other users.
If you use a message board, comment function, conversation pages, blogs, social community environments, profile pages, or other public or semi-public venue or forums of the Services, you will be identified on those venues by the username you submit.
We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your Information. Your controls and choices may include:

Our Services may contain links to other sites operated by third parties. Neither Pace nor Company controls such other sites and is not responsible for their content, their privacy policies, or their use of Personal Information. Information you provide on public or semi-public venues, including Information you share on third party social networking platforms (such as Twitter, Discord and secondary NFT marketplaces) may also be viewable by other users of the Services and users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such sites or of their owners or operators except as disclosed on the Services. Pace and Company expressly disclaim any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of Personal Information by third parties. Any information submitted by you directly to these third parties is subject to that third party's privacy policy.
Neither Pace nor Company seeks or knowingly collects any Personal Information about children under 13 years of age. If Pace or Company become aware that we have unknowingly collected Personal Information from a child under the age of 13, we will make commercially reasonable efforts to delete such information from our database
If you are the parent or guardian of a minor child who has provided us with Personal Information, you may contact us to request it be deleted
  • 9.1General. We use reasonable security measures, including computer safeguards and secured files and facilities that comply with federal law to protect and limit access to Personal Information. Please note that Information you send to us electronically may not be secure when it is transmitted to us. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us. From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable.   • 9.1Wallet Applications. All transactions initiated through the Services are run by multi signature wallets or third-party electronic wallet applications that you choose to use, such as Metamask. By using the Services you agree that you are governed by the terms or service and privacy policies of those wallet applications.
We may modify this Privacy Policy from time to time in which case we will update the “Last Revised” date at the top of this Privacy Policy. If we make changes that are material, we will use reasonable efforts to attempt to provide notice to you and, where required by applicable law, we will obtain your consent. This Privacy Policy describes how we may share your Information for marketing purposes. It applies to all users of the Services, including California residents.
